Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you,” “your,” or “Client”) and Haute Haus OC (“Haute Haus,” “we,” “us,” or “our”), governing your use of our website at hautehauspilates.net our studio located at 5031 e orangethorpe ave Anaheim CA, our class booking platform, and all related services (collectively, the “Services”).

By accessing our website, creating an account, purchasing a membership or class package, or attending any class, you agree to be bound

by these Terms. If you do not agree, do not use our Services.

1. Eligibility

1.1 Age Requirement

You must be at least sixteen (16) years of age to use our Services or attend any class 

1.2 Parental Consent for Minors

If you are between the ages of 16 and 17, your parent or legal guardian must (a) review and agree to these Terms on your behalf, (b) sign a Liability Waiver and Assumption of Risk Agreement on your behalf, and (c) provide written consent for your participation. A parent or legal guardian is responsible for all acts and omissions of any minor using our Services.

1.3 Accurate Information

You agree to provide accurate, current, and complete information when creating an account or making a purchase, and to update such information as necessary.

2. Accounts and BookinG

2.1 Account Registration

To book classes and purchase memberships or class packages, you must create an account through our booking platform, currently provided by Mariana Tek. Your account is personal to you and you are responsible for maintaining the confidentiality of your login credentials. You are responsible for all activity that occurs under your account.

2.2 Class Booking

Classes may be booked through your account on our booking platform. Class availability, schedules, and instructors are subject to change without notice. We reserve the right to cancel, reschedule, or modify any class at our discretion. 

2.3 Late Arrival

If you arrive after a class has begun, you may be denied entry at the instructor’s discretion. No refund, credit, or replacement class will be provided for late arrivals.

2.4 Class Cancellation by Client

Our cancellation window and any applicable late-cancel fees will be posted on our booking platform. Failure to cancel within the required window or failure to attend a booked class (“no-show”) may result in forfeiture of the class credit or a late-cancel fee, as applicable.

3. Memberships, Class Packages, and Pricing

3.1 Offerings

We offer the following types of purchases (collectively, “Purchases”):

  • Monthly Unlimited Memberships — Unlimited classes per month on a recurring billing cycle.

  • Class Packs — A set number of class credits purchased in advance.

  • Drop-In Classes — Single-class purchases.

  • Introductory Offers — Promotional packages for new clients, subject to additional terms specified at the time of purchase.

Pricing for all Purchases is as listed on our booking platform at the time of purchase and is subject to change. Price changes will not affect active memberships during their current billing cycle.

3.2 Payment

All payments are processed through Stripe. By making a Purchase, you authorize us (and our payment processor) to charge the payment method on file. You are responsible for ensuring your payment method is valid and has sufficient funds. If a payment fails, we may suspend your account until the outStanding balance is resolved.

3.3 Auto-Renewal of Monthly Memberships

IMPORTANT — AUTOMATIC RENEWAL NOTICE: Monthly Unlimited Memberships are automatically recurring subscriptions. Your membership will automatically renew at the end of each billing cycle, and the then-current membership rate will be charged to your payment method on file, unless you cancel before the renewal date.

You will receive a confirmation of your membership terms, including the renewal terms and pricing, at the time of purchase. You may cancel auto-renewal at any time as described in Section 3.4. 

3.4 Cancellation of Monthly Memberships

You may cancel your Monthly Unlimited Membership at any time through your account on our booking platform or by contacting us at the email address provided in Section 12. Upon cancellation:

  • No refunds will be issued for the current billing period.

  • Your membership benefits will remain active through the end of your current paid billing period.

  • No further charges will be made after the end of the current billing period.

3.5 Class Packs

Class pack credits must be used within six (6) months of the date of purchase. Unused credits will expire at the end of this period without refund.

3.6 No Refunds

All Purchases are final and non-refundable. This includes, without limitation, monthly membership fees, class pack purchases, drop-in class purchases, and introductory offer purchases. No refunds, credits, or exchanges will be issued for unused classes, missed classes, or early cancellations.

3.7 Promotional Offers

Introductory and promotional offers are available to eligible clients as specified in the applicable offer terms. We reserve the right to limit promotional offers to one per person and to modify or discontinue promotions at any time. Promotional pricing will not be applied retroactively.

4. Studio Rules and Conduct

4.1 Studio Policies

All clients must comply with studio rules and policies as posted in the studio or communicated by staff. We reserve the right to establish, modify, and enforce studio rules at any time.

4.2 Proper Conduct

You agree to treat all staff, instructors, and fellow clients with respect. We reserve the right to refuse service to, or revoke the membership of, any individual who engages in disruptive, abusive, harassing, or unsafe behavior.

4.3 Personal Belongings

Haute Haus is not responsible for any personal belongings lost, stolen, or damaged at the studio.

4.4 Health and Safety

You are responsible for disclosing any health conditions, injuries, or physical limitations to your instructor before each class. You must follow all instructor guidance regarding proper form and use of equipment. You acknowledge that the Haute Haus method involves physical exertion and use of specialized equipment and that participation carries inherent risks. A separate Liability Waiver and Assumption of Risk Agreement is required before your first class. 

5. Intellectual Property

5.1 Our Content

All content on our website and booking platform, including text, graphics, logos, images, and software, is the property of Haute Haus or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any of our content without our prior written consent.

5.2 Trademarks

“Haute Haus” and our logo are trademarks of Haute Haus OC LLC. You may not use our trademarks without our prior written consent.

5.3 Class Content

All class formats, sequences, programming, and instructional methods used in our classes are proprietary. You may not record, reproduce, or distribute any class content.

6. Website Use

6.1 Permitted Use

You may use our website for its intended purposes: learning about our Services, creating an account, booking classes, and managing your membership. You may not use our website for any unlawful purpose or in any manner that could damage, disable, or impair the website.

6.2 Prohibited Conduct

You agree not to:

  • Attempt to gain unauthorized access to any part of our website or systems.

  • Use automated tools (bots, scrapers, crawlers) to access or interact with our website.

  • Interfere with or disrupt the integrity or performance of our website.

  • Transmit any malware, viruses, or harmful code.

  • Impersonate any person or entity.

7. Third-Party Services

Our Services integrate with third-party platforms, including Mariana Tek (class booking and account management) and Stripe (payment processing). Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of any third-party services.

8. Limitation of Liability

8.1 Disclaimer of Warranties

OUR SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Haute Haus OC LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, INSTRUCTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF YOUR USE OF OR INABILITY TO USE OUR SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNTS YOU HAVE PAID TO Haute Haus LLC IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

8.3 Acknowledgment

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

9. Indemnification

You agree to indemnify, defend, and hold harmless Haute Haus OC LLC, its Members, officers, employees, instructors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:

  • Your use of our Services.

  • Your violation of these Terms.

  • Your violation of any applicable law or regulation.

  • Any dispute between you and any third party.

10. Dispute Resolution

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of CA, without regard to its conflict-of-laws principles. 

10.2 Jurisdiction and Venue

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Anaheim Ca. You consent to the personal jurisdiction of such courts and waive any objection to venue.

10.3 Waiver of Jury Trial

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND Haute Haus OC LLC EACH WAIVE THE RIGHT TO A JURY TRIAL FOR ANY DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES.

10.4 Limitation on Claims

Any claim arising out of or relating to these Terms or the Services must be filed within one (1) year after the cause of action accrues, or such claim shall be permanently barred.

11. General Provisions

11.1 Entire Agreement

These Terms, together with our Privacy Policy and any Liability Waiver and Assumption of Risk Agreement you execute, constitute the entire agreement between you and Haute Haus OC LLC with respect to the Services and supersede all prior agreements and understandings.

11.2 Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

11.3 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of such provision or any other provision.

11.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

11.5 Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated by posting updated Terms on our website or by email notification. Your continued use of the Services after any modification constitutes your acceptance of the revised Terms. 

11.6 Electronic Communications

By using our Services, you consent to receiving electronic communications from us, including transactional emails, booking confirmations, and account-related notices. You agree that all agreements, notices, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

By opting in, you agree to receive recurring automated text messages from Haute Haus ("we," "us," "our") at the mobile number you provided. Messages may include [appointment reminders, order updates, account alerts, promotional offers, customer support follow-ups, etc. — customize to your actual use case]. Consent to receive these messages is not a condition of any purchase.

2. Message Frequency
Frequency may vary depending on your activity and interactions with us.

3. Message and Data Rates
Message and data rates may apply. Charges are billed by and payable to your mobile service provider. Please contact your wireless carrier for details about your messaging plan.

4. How to Opt Out and Get Help
You can unsubscribe the SMS service at any time by replying STOP to any message we send you. After you send STOP, you will receive a one-time confirmation message, and no further messages will be sent. If you want to rejoin, you can sign up again using the original opt-in method or reply START. For help or more information at any time, reply HELP to any of our messages. 5. Carrier Liability Disclaimer
Carriers are not liable for any delayed or undelivered messages.
